Abstract Child Labor Law

This summary is for general information and is not to be considered in the same legal manner as official statements contained in the Law or its regulation.

Every employer must have an Employment Certificate before he/she permits minors, age 14 through 17 years, to work at times that will not interfere with regular school attendance. This also is required for minors, ages 12 and 13, employed as caddies.

Exception:
Minors 17 years of age who have graduated from an accredited high school, or who are no longer on the active school roll, are not required to have an Employment Certificate.

Maximum Legal Hours:
Minors under 18 years of age may not be employed for more than eight [8] hours a day, 44 hours a week, six days a week; nor more than five [5] hours continuously without an interval of 30 minutes for lunch.

Other Hourly Limitations:
Students 16 and 17 years of age may not be employed for more than 28 hours per school week [Monday through Friday], with eight [8] hours on Saturday and/or Sunday, during the school term.

Minors, ages 14 and 15 years, may not be employed for than four[4] hours on a school day or 18 hours during a school week [Monday through Friday], with eight [8] additional hours on Saturday and Sunday.

Minors, ages 12 and 13 years, employed as golf caddies may carry not more than one golf bag and for a maximum of 18 holes a day.

Night Work:

Students 16 and 17 years of age may not be employed before 6 a.m. or after 11 p.m.. [midnight on days preceding non-school days]. Minors under 16 years of age may not be employed before 7 a.m. nor after 7 p.m. [10 p.m. on days preceding non-school days].

Applying for Works Permits

A parent/guardian must accompany the student and present a birth certificate of baptismal certificate to the main office of the High School and sign the application denoting permission. Following this, it is necessary for the student to:

   1.

      Get a physical examination [only one ever required] and have the physician sign Section "C."
   2.

      Have the prospective employer fill out and sign Section "B" designating hours student is expected to be employed.
   3.

      Return the application to the High School main office. The permit will be issued to the student in the office and additional instructions will be given at that time.
